A minor debt is one of, or less than $7,500 NOW $25,000 in QLD that is owed by a person to a business or between businesses (QLd). Examples of this are money lent, credit given, an IOU, a dishonoured cheque, wages owing under an oral or written agreement, cost of work done on contract, half the cost of a dividing fence where this was agreed prior to construction.
A small debt (Small claims Tribunal) is an amount owed by a business to an individual, equal to or less than $7,500 (Qld) NOW $25,000 in QLD. Examples of this type of debt include that you have losses or damages, problems about goods and services, conflict about goods or services between traders, bond held by the Rental Bond Authority, claims arising from residential building work (Qld Building Tribunal dispute).
The tribunal also covers matters such as residential tenancy Disputes, Debt Disputes, Consumer and Trader Disputes, Minor Civil Disputes, Building Disputes, Retial Shop Lease Disputes. For more on QCAT.
These amounts and terms vary, state to state, but the basics remain the same. The new standard for these claims is slowly becoming between $10,000 and $25,000 as States come into line.
The cost for small and minor debts vary based on value, location and degree of difficulty, between $330 and $2650 (GST inclusive) ** __________________________________________________________________________
Amounts over $7,500 (or $10,000, or $25,000 depending on the State) come under our Commercial and Consumer Debt Collection service.
For these debts our standard rate is $550 for your initial consult and process fee, plus 11% of the debt recovered. **
For ongoing matters with multiple debtors our retainer is $1100 a year, plus 11% of the debt recovered. **
For multiple jurisdictions or National Business debt recovery our retainer is between $4400 and $10,000 a year, plus 11% of debt recovered - the price varies depending on the complexity, number and size of debts. **
For International debt recovery, retainer is by negotiation plus 11% of debt recovered.

If the matter must progress to Commercial litigation we will conduct an appraisal of your matter (free), and provide initial advice as to the benefits of proceeding. We will direct you to a suitable litigation specialist, and provide advice on the legal action, your options and the process of commercial litigation.
The cost of litigation, should it proceed, will be that of the creditor. We work to your instructions.
Any submissions by debtors for a payment plan will be discussed with you, prior to any agreement being made.
-------------------------------------------------------------------------------------- As these matters are a State by State consideration, generally, as to jurisdiction, and cut-offs for various courts, here are other examples such as Western Australia's system. The jurisdiction in which a debt falls is dictated by either the place where the debt was incurred, or an agreement signed stating that the debt, wherever obtained, will fall under a particular State Court system (these may be disputed).
