When looking at collecting a debt you have three choices, generally. These are to try and collect the debt yourself, to contact a solicitor / lawyer or to engage the services of a Debt Collector / Collection Agency / Mercantile Agents / Repossession Agent (They are all debt collectors).
Why choose a debt collector??
Because a debt collector will only charge a small establishment fee plus a percentage of value of recovered debt, or an agreed amount.
Well, if it was easy to collect the debt yourself the bad debt wouldn't exits.
If you use a lawyer / solicitor they will expect a hefty fee up front to commence action, and they expect that they will be paid in advance as the matter progresses (Think thousands of dollars). They utilise the court system as the preferred method for proceeding. The court is not about justice, it is about the law. You may end up paying more than the value of the debt.
The value of the recovered debt will always be more than the fee paid, generally. ________________________________________________________________________ Can you guarantee that you will recover the debt or the item??
No. We, unfortunately, don't have a crystal ball. However, we have the incentive of maintaining our reputation as well as, for larger jobs, the incentive of receiving a percentage of the monies recovered.
We aim to make it uncomfortable as we legally can for the person/business owing the debt. We have the advantage of being able to list them a bad debtors which can affect their credit rating and ability to rent housing. We can approach them at home and at work. We cannot step outside the privacy guidelines, however, people draw their own conclusions when confronted by a debt collector looking for someone. The only way to lift that listing is to come back to us. For the recalcitrant debtor this gives us leverage to collect that outstanding amount.
We are looking to negotiate an outcome, to bring them to the table. To arrange payment. We will advise you to go to court as a last resort, unfortunately, in court quite often the only winners are the legal counsel of both sides. ________________________________________________________________________ How long will it take?
A large percentage of our files are completed within a month. Some files may take years. ________________________________________________________________________ Do you take legal action on our behalf??
No. Only you, or your legal representative, can commence action. We can guide you, and prepare matters for you. We can also apply pressure to resolve the matter through providing information to the debtor in the correct light, with regards legal action commencing.
Speed is of the essence in recovering debt. Please
contact us as soon as you are aware that a matter has gone outside the
terms of trade or is overdue.
